These Terms of Service ("Terms") govern your use of the lenkidin.click website and any estimate, quote, project agreement, or service provided by Wainscot & Panel Co. ("we," "us," "our"), owned and operated by Bradley Foster. By using our website or engaging our services, you agree to these Terms.
1. Acceptance of Terms
By submitting a contact form, requesting an estimate, or engaging Wainscot & Panel Co. for services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Description of Services
Wainscot & Panel Co. provides custom wainscoting, board-and-batten, shaker and flat-panel wall paneling, chair rail and trim installation, and related residential carpentry and paint-finish services in the Kansas City, MO metropolitan area. Website content, pricing ranges, and portfolio images are for general informational purposes; final project scope and pricing are established in a signed written project agreement.
3. Estimates & Project Agreements
Estimates provided through the website or an initial consultation are non-binding until formalized in a signed project agreement specifying scope, materials, timeline, and price. Prices shown on this website are typical ranges only and do not constitute a binding quote.
4. Payment & Deposit Terms
Projects generally require a deposit (typically 30-50% of project total) prior to material ordering and scheduling, with the balance due upon completion or per a milestone schedule specified in the project agreement. Late payments may be subject to a service charge as disclosed in the project agreement.
5. Cancellation & Refund Policy
Clients may cancel a scheduled project with at least 48 hours' notice prior to the scheduled start date for a full refund of any deposit not yet applied to custom-ordered materials. Once custom materials have been ordered or fabrication has begun, deposits become non-refundable to the extent they cover materials and labor already committed. This policy reflects standard practice for custom, made-to-order paneling work; U.S. law does not provide a statutory withdrawal period for custom-fabricated goods and services of this kind.
6. Scheduling & Delays
Project timelines are estimates and may be affected by material availability, weather, site conditions, or change orders. We will communicate any material delays promptly.
7. Change Orders
Any changes to project scope, materials, or design after the project agreement is signed must be documented in writing and may affect price and timeline.
8. Warranty
Wainscot & Panel Co. warrants its workmanship against defects for a period of two (2) years from project completion, excluding damage from normal wood movement, humidity changes, misuse, or third-party modification. Manufacturer warranties on materials and finish products, where applicable, are passed through to the client.
9. Intellectual Property
Design layouts, panel profiles, and custom drawings created by Wainscot & Panel Co. remain our intellectual property unless otherwise agreed in writing. Photographs of completed projects may be used in our portfolio, website, and marketing materials unless the client requests otherwise in writing prior to project completion.
10. Limitation of Liability
To the maximum extent permitted by law, Wainscot & Panel Co.'s total liability for any claim arising from our services shall not exceed the total amount paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
11. Insurance & Licensing
Wainscot & Panel Co. maintains general liability insurance and operates under MO Home Improvement Contractor License #HC-204871. Certificates of insurance and license verification are available upon request.
12. Governing Law & Venue
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any dispute arising from these Terms or our services shall be resolved in the state or federal courts located in Jackson County, Missouri.
13. Dispute Resolution
Before pursuing formal legal action, both parties agree to attempt good-faith resolution through direct negotiation. If unresolved within 30 days, either party may pursue mediation or applicable legal remedies in Jackson County, Missouri.
14. Website Use
Content on lenkidin.click is provided "as is" for informational purposes. You agree not to misuse the website, attempt unauthorized access, or use it for unlawful purposes.
15. Changes to These Terms
We may revise these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of our website or services after changes constitutes acceptance.
